LEGAL NOTICES BIBLIOSCORES S.L.
This document aims to describe the legal notices and basic legal framework of the privacy and cookies policies included in the platform (APP) «FARISTOL», owned by BIBLIOSCORES S.L. (hereinafter referred to as BIBLIOSCORES).
DESCRIPTION
The «FARISTOL» Platform (hereinafter referred to as the APP) is a platform designed to connect composers and performers through an online sheet music platform. To achieve this, users registered as «COMPOSERS» can share their sheet music online, which is accessible to users registered as «PERFORMER».
LEGAL NOTICES: TERMS AND CONDITIONS OF USE
The use of the APP is governed by these General Terms and Conditions of Use, so we strongly advise you to carefully read these Conditions before accessing it. The USER acknowledges being aware of the existence of these Terms of Use and the need to know them.
By registering on the APP, the user fully and completely accepts these Conditions. Otherwise, the user should not use the APP. Any person who accesses the APP will be considered a USER. Within the USERS, the following distinctions will be made:
USERS who register on the APP to add sheet music as composers or editors (hereinafter referred to as Composer USERS).
USERS who register to browse the APP as performers, teachers, or directors (hereinafter referred to as Performer USERS).
When referring to these groups collectively, they will be referred to as USERS.

- Object These General Terms and Conditions of Use regulate the access to and use of the APP. BIBLIOSCORES provides USERS with an APP that allows, through various options, the sharing and viewing of sheet music online. Once registered, the APP offers USERS various features such as uploading sheet music, accessing them, graphics, a compensation service for sheet music viewing, creating favorite folders, notification service, among other content.
- Conditions of access and use of the APP 3.1 Free access The use of the APP is free of charge. However, access to some of the tools within the APP may be subject to payment of a fee, in which case it will be indicated in these Conditions. 3.2 Creation of an account in the APP and the various types of USERS To use the APP, it will be necessary to create a USER account within the platform, providing all the requested data. In this sense, the username and password are for the personal use of the USER and must be kept confidential. Under this agreement, USERS will be responsible for any use of their username and password, including any unauthorized use thereof. In this regard, the use of this password is personal and non-transferable; therefore, the USER must take necessary measures for its custody. The USER is solely responsible for the use made of their password, with BIBLIOSCORES being exempt. As indicated, USERS will be distinguished by the following roles:
- Composer USERS, who register on the APP to add and share sheet music.
- Performer USERS, who register to browse the APP and access sheet music.
To register on the APP:
i. Registration must always be done under the Performer mode.
ii. Once registered in this manner within the platform, the USER whose role does not match that of a performer must request the Composer mode within the platform.
iii. Through this profile, the USER will have access to both modes (Composer USER and Performer USER).
Regarding Performer USERS, the following Conditions will apply. For COMPOSER, the conditions mentioned in the following sections, 3.3 and 3.4, will apply.
3.3 Conditions for Composer USERS
The USER who registers as a Composer/Editor USER will have access to their Profile, from where they can add as many sheet music pieces as desired, without any cost incurred. When the Composer/Editor USER wishes to add sheet music to their profile, they must fill out a form providing information about it (title, instrumentation, brief description of the piece, year, cover art, etc.). 3.3.1 Rights of Composer/Editor USERS The Composer/Editor USER will have the following rights within the APP:
- Upload, edit, and/or delete their own sheet music within the platform.
- Access to other sections, such as statistical graphs, that facilitate the use and analysis of the platform, providing information on views, trending music, and/or other general information.
- Receive financial compensation according to the number of views received.
- Recognition of authorship of the sheet music performed by third parties.
- Access to other services oriented towards their profile.
3.3.2 Compensation System for Views.
The Composer USER will receive financial compensation according to the number of views of their sheet music. This calculation will be based on the following formula:
20% of BIBLIOSCORES’s total net profits / total views = Amount per view
Once the «amount per view» figure is obtained, it will be multiplied by the number of views each composer has, thereby obtaining the compensation that the composer will receive. They will be able to see the views obtained live and will receive the corresponding compensation every 3 months.
Likewise, in relation to the profits obtained by the APP, Composer USERS undertake to fulfill tax declaration obligations, under their exclusive responsibility (and exempting BIBLIOSCORES from the same), in accordance with applicable legislation on the matter.
3.3.3. Commitments of Composer USERS
The Composer USER acknowledges that BIBLIOSCORES will ensure the correct use of the APP. In this regard, upon registration, the Composer USER guarantees, under their exclusive responsibility (and exempting BIBLIOSCORES from the same), the following:
- That all provided information is truthful and accurate.
- They declare themselves the legitimate owner of all intellectual and industrial property rights over the content they insert into the APP. Likewise, they undertake that the sheet music uploaded within the platform does not violate the rights of third parties. In this regard, BIBLIOSCORES is not responsible for any claims that may be made regarding the content inserted by the Composer USER.
- To report any problems or incidents with the APP to improve the experiences of future participants; even, if necessary, collaborating to offer appropriate solutions to conflicts or undesirable unforeseen events.
- To use the APP in accordance with the law, good customs, and these Conditions.
Similarly, the Composer USER accepts and consents that BIBLIOSCORES may reject their participation in the APP if, originally or subsequently, they do not comply with the requirements and guarantees to which they are obligated by accepting these Conditions. If so, the USER accepts that BIBLIOSCORES may terminate the existing connection with the USER, deleting the sheet music they have uploaded within the APP and/or their USER profile within the APP, waiving any claims for this reason.
3.3.4 Unsubscribing from the APP
The Composer USER may cancel their registration for the service at any time during its validity. This cancellation will not incur any penalty, nor will it be necessary to indicate the reasons for canceling the subscription. Cancellation can be done through the USER’s profile, in the following section: Menu/profile/cancel subscription. In this regard, canceling the service will result in no access to any of the services offered by the APP, as well as no financial compensation for the viewing of sheet music, which will no longer be accessible in the APP.
3.4 Conditions for Performer USERS
Performer USERS who register on the APP will have access to online sheet music for free without the need to purchase a subscription. However, it should be noted that with free registration, advertisements may appear. However, there are other services or tools within the APP that Performer USERS cannot access without a subscription. The subscription modalities are «BASIC» and «PREMIUM», detailed in the following section. 3.4.1 Rights of Performer USERS The USER will have the right to navigate the platform freely and without limitations. In the case of subscriptions in the different «BASIC» and «PREMIUM» modalities, USERS will also have the right to the following APP services: A. «BASIC» subscription modality:
- Access to all online sheet music within the platform without advertising content. B. «PREMIUM» subscription modality: In addition to the services mentioned above for the «BASIC» subscription, the following services will also be available:
- Perform unlimited technical and/or interpretive annotations, provided they comply with the conditions stated above.
- Acces to the FAVORITE secction
3.4.2. Obligations
The Performer USER acknowledges that BIBLIOSCORES will ensure the proper functioning within the APP. In this regard, upon registration, the USER guarantees, under their exclusive responsibility (and exempting BIBLIOSCORES from the same), the following:
- All provided information is truthful and accurate.
- They commit to using the platform in accordance with current regulations, good customs, and these Conditions.
- When using the sheet music, they will comply with current intellectual property regulations and mention the author of the sheet music used, exempting BIBLIOSCORES from any responsibility.
- To report any problems or incidents with the APP to improve the experiences of future participants; even, if necessary, collaborating to offer appropriate solutions to conflicts or undesirable unforeseen events.
- To use the APP in accordance with the law, good customs, and the present legal notices of the APP.
3.4.3. Subscription: Payments and Cancellation i. Payments The Performer USER can acquire two payment subscription modalities (BASIC or PREMIUM):

PREMIUM €5.99
The prices above include VAT in accordance with Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. Once the subscription modality is chosen, it will automatically renew at the end of the applicable subscription period unless the USER cancels their payment subscription before the current subscription period ends. BIBLIOSCORES may modify the price of payment subscriptions, committing to communicate changes in rates to USERS well in advance. Changes in subscription rates will take effect at the beginning of the next subscription period following the date of the price change. If the USER does not agree with a price change, they may cancel the corresponding payment subscription before the price change takes effect. To cancel their subscription, the USER must access the configuration options offered in their profile, selecting the «cancel subscription» option, which will be automatic. Cancellation will not, under any circumstances, result in the refund of amounts that the USER has paid up to that time as subscription payment. This amount is non-refundable. BIBLIOSCORES may unilaterally cancel the subscription due to non-payment by the USER. If BIBLIOSCORES decides to discontinue a service for business or other reasons not related to the USER’s breach of any of the General Conditions, it must notify the affected USER with reasonable advance notice to give them the opportunity to cancel the subscription if they wish, at no additional cost. If this happens, BIBLIOSCORES will refund the USER the corresponding amounts for the remaining subscription period, if applicable.
ii. Cancellation: Right of Withdrawal
In the case of subscriptions, in accordance with current legislation, the USER has a withdrawal period of 14 days from the date of purchase. Within this period, the USER may exercise their right of withdrawal with BIBLIOSCORES for any reason, but must pay for the services provided up to the point of notification. To do so, simply unsubscribe from the service within the profile created within the APP. 3.4.4 Unsubscribing from the APP Performer USERS who have registered in the free modality may cancel their registration for the service at any time during its validity. This cancellation will not incur any penalty, nor will it be necessary to indicate the reasons for canceling the subscription.
3.5 Content
The language used by BIBLIOSCORES in the APP will be English. BIBLIOSCORES will not be responsible for the USER’s lack of understanding or comprehension of the language used in the APP, nor for any consequences that may arise from it. BIBLIOSCORES may, without prior notice, expand its portal to new services, activities, or content in order to improve the performance and quality of the service offered. Likewise, BIBLIOSCORES may, without prior notice and without any justification, modify and/or remove any content hosted in the APP, as well as the way to access this content. USERS may not use the content of the APP to disseminate or promote information or advertising from themselves or third parties without the express authorization of BIBLIOSCORES. BIBLIOSCORES includes within the content and updates of the APP, links or hyperlinks that incorporate third parties for opening the complete APP and to provide the USER with the possibility of sharing their activities on social networks. In this regard, BIBLIOSCORES is not responsible for the third-party links included in the APP. Such links are provided for informational purposes only and do not imply endorsement, approval, commercialization, or any relationship between BIBLIOSCORES and the individuals or entities who are authors and/or managers of such content or owners of the social networks where they are located.
4. Content and Intellectual Property Rights
4.1 User Content
As indicated in clause 3, the USER who publishes content within the APP confirms being the owner or having the necessary authorizations. Likewise, they undertake that such content does not infringe applicable laws, these Conditions, as well as the intellectual property rights, or other types, of third parties. When publishing or sharing sheet music within the APP, the USER must consider that the contents may be publicly accessible and may be used and shared by Performer USERS. In this regard, BIBLIOSCORES is not responsible for what USERS upload within the APP. 4.2 Content Supervision BIBLIOSCORES may monitor or review the content uploaded by USERS. In this regard, BIBLIOSCORES reserves the right to delete or disable access to any USER content. Likewise, BIBLIOSCORES may take these measures without prior notice when it has become aware of acts that constitute a a violation of third-party intellectual and industrial property rights
4.3 Licenses Granted by the Composer USER to BIBLIOSCORES
The Composer USER retains ownership of the uploaded content when published within the APP. However, for the operation of the APP, the USER grants BIBLIOSCORES a limited license over the copyrightable material. In this regard, the USER grants BIBLIOSCORES a non-exclusive, transferable, sublicensable, worldwide license to reproduce, make available to the public, distribute, publicly communicate, and use in any other way the sheet music within the USER’s use of the APP. Likewise, the Composer USER authorizes Performer USERS to employ, perform, interpret, use, publicly communicate, as well as interpret with an instrument other than that indicated in the form, the sheet music uploaded within the APP, provided that such use is lawful, in accordance with good customs, and in accordance with what is established within these Conditions. Similarly, the Composer USER authorizes Performer USERS to make technical and/or interpretive annotations. In this regard, the annotations will be in accordance with the provisions of section 3.4.1.
4.4 Industrial and Intellectual Property of the APP
All content of the APP that has not been uploaded by USERS (including, but not limited to, texts, photographs, graphics, images, icons, technology, software, source and object code, links, and other audiovisual material and graphic design (hereinafter, the CONTENT) is the exclusive property of BIBLIOSCORES or third parties (with BIBLIOSCORES being the only authorized party to use it), and the USER agrees to respect and not infringe or copy it. In no way are the exploitation rights recognized by current copyright legislation transferred to the USER, except for those that are strictly necessary for the use of the APP. In line with the above, accessing the APP does not grant any rights over the trademarks, trade names, and/or logos appearing therein, nor does it grant any kind of license or authorization for the use of its elements and rights. Likewise, the copying, reproduction, adaptation, modification, distribution, commercialization, public communication, and/or any other action that constitutes an infringement of current Spanish and/or international legislation on intellectual and/or industrial property, as well as the use of the contents of the APP without the prior express written authorization of BIBLIOSCORES, are strictly prohibited. Any unauthorized use of the content of the APP will constitute a violation of Intellectual Property laws, Industrial Property laws, and/or unfair competition, as well as other possible regulations, against which BIBLIOSCORES will initiate and exercise any civil and/or criminal actions that correspond against those who infringe or damage its rights.
4.5 Claims for Infringement
BIBLIOSCORES respects the rights of USERS.
If the USER or a third party believes that their intellectual property rights have been infringed by the content uploaded within the APP, they must immediately inform this circumstance to the following email f.bolo@biblioscores.com and include the following information: • Identification of the intellectual property right that they believe has been infringed. • Identification of the content they believe infringes their rights, as well as the link where such content is located within the APP. • Contact information, as well as an email address to respond to. • A statement in good faith that the use of the work(s) in the manner claimed is not authorized by the copyright holder, its agent, or the law. • A statement that the provided information is accurate, and that the claiming USER is (or is authorized to act on behalf of) the intellectual property rights holder. • If available, the document that can serve to prove ownership of such rights. BIBLIOSCORES may provide the name of the rights holder, the provided email address, and the content of the communication to the USER who uploaded the content considered infringing.
5.Privacy Policy and Data Protection
BIBLIOSCORES has established a privacy and data protection policy regarding personal data, which collects, processes, or stores such data and which is included in the Privacy Policy of the APP.
6. Exclusion of Guarantees and Liability
The USER acknowledges that the use of the APP and its contents and services is carried out under their exclusive responsibility. Specifically, by way of example only, BIBLIOSCORES assumes no responsibility in the following areas: • The availability of the operation of the APP, its services, and contents, and their quality or interoperability.
• The suitability for the purposes for which the APP serves the USER’s objectives.
• The infringement of current legislation by the USER or third parties, particularly regarding intellectual and industrial property rights owned by other individuals or entities.
• The existence of malicious code or any other harmful computer element that could cause damage to the USER’s computer system or to third parties. It is the USER’s responsibility, in any case, to have adequate tools for the detection and disinfection of these elements.
• Fraudulent access to content or services by unauthorized third parties, or, where applicable, the capture, elimination, alteration, modification, or manipulation of messages and communications of any kind that such third parties may carry out.
• The accuracy, truthfulness, timeliness, and usefulness of the contents and services offered and their subsequent use by the USER. BIBLIOSCORES will make every effort and reasonable means to provide updated and reliable information.
• Damages caused to computer equipment during access to the APP and damages caused to USERS when they originate from failures or disconnections in telecommunications networks that interrupt the service. • Damages or losses arising from circumstances beyond reasonable control or force majeure.
7. Changes or Modifications
BIBLIOSCORES reserves the right to periodically modify the terms of this document. The modified conditions will come into effect on the date of their online publication in the APP for all USERS. In such a case, BIBLIOSCORES will adequately inform USERS of these changes. Continued use of the APP will constitute acceptance by USERS of the modified Conditions. If USERS do not wish to be bound by these changes, they may cancel their account by contacting BIBLIOSCORES.
8. Applicable Law
These General Terms of Use shall be governed by Spanish law. Likewise, in the event of any conflict or controversy arising from this APP, it shall be submitted to the Spanish Courts and Tribunals, particularly those located in the city of Alicante. Additionally, in accordance with EU Regulation No. 524/2013, USERS shall have the right to request an out-of-court resolution of disputes regarding the provision of services through the APP. In this regard, the out-of-court resolution method is accessible through the following link: http://ec.europa.eu/consumers/odr/.
POLICY PRIVACY
The purpose of this policy is to inform stakeholders about the various treatments we carry out that affect their personal data in accordance with the provisions of Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016.
Likewise, we recommend that the privacy policy be located in a separate section of the APP, distinct from the legal notice and the cookie policy.

2.1. Identification and contact details of the data controller

There is no Data Protection Officer appointed as there is no legal obligation to do so.
2.2. Purpose of processing personal data of USERS:
We will process the personal data provided through user registration and personal profiles to:
- Provide the FARISTOL Service in accordance with the registration and/or subscription made.
- Attend to information requested by USERS.
- Conduct quality surveys.
- Monitor information on the APP to prevent any data security breaches, which may involve accessing personal data of users.
- Protect our rights or respond to claims of any kind.
- For marketing purposes. On certain occasions, BIBLIOSCORES will use the personal data provided for sending marketing communications through various platforms. However, we will explicitly request consent when required by law. In the event of receiving such communications, we will fulfill our duty to inform you on how to unsubscribe.
- Process payments according to the number of views received per score.
The basis for the processing of personal data by BIBLIOSCORES is supported by:

- Respond to inquiries, complaints, or incidents transmitted by the data subject through the «Contact» forms incorporated in the APP or by sending an email to the following address: f.bolo@biblioscores.es
- Sending communications related to the services offered by BIBLIOSCORES.
- Sending commercial and advertising information.
Refusal to provide personal data will result in the impossibility of processing the data for the mentioned purposes.
Legal obligation applicable to the data controller:
BIBLIOSCORES must process your data to comply with a legal obligation imposed by the legal system. For example, the obligation to provide tax information to the tax authorities (AEAT). In this case, the data subject cannot refuse the processing of personal data.
In certain cases, it will be necessary to process your data to satisfy legitimate interests pursued by the data controller, provided that they prevail over the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data. The processing activities that we will carry out based on the legitimate interests of the organization are as follows:
- Computer monitoring of the APP to prevent any data security breaches.
- Verify your identity or the information provided to us for the provision of the subscribed or acquired service.
- To manage your data and provide them, if necessary, to external providers for the proper functioning of our business.
- To improve our services and your experience in browsing and using the APP.
- To protect our rights or respond to claims of any kind.
2.3 Data retention periods or criteria:
The personal data provided will be kept in accordance with the following criteria:
- The time necessary to fulfill the purposes for which they were initially collected.
- Once the data are no longer necessary for the processing in question, they will be duly blocked, for their availability to the competent Public Administrations, Courts, or the Public Prosecutor’s Office during the statute of limitations of the actions that may arise from the relationship maintained with the client and/or the retention periods provided by law.
2.4 Automated decisions and profiling:
BIBLIOSCORES does NOT make automated decisions based on logic.
2.5 Recipients
BIBLIOSCORES will not carry out International Transfer of USER Data. It will also not disclose names, email addresses, or personal information of USERS other than the name or Nick that the USER decides to keep public.
Notwithstanding the above, during the period of processing of your personal data, BIBLIOSCORES may disclose your data to Public Authorities, Judges and Courts, and Law Enforcement Authorities, and in general, competent authorities, when the data controller has the legal obligation to provide such personal data.
2.6 Rights
Individuals who are the subject of any processing carried out by BIBLIOSCORES may exercise, at any time and free of charge, the rights of access, rectification, and erasure, as well as request the restriction of processing of their personal data, object to it, request data portability (where technically feasible), or withdraw consent, and where applicable, not to be subject to a decision based solely on automated processing, including profiling.
To do so, you can use the «Contact» access in the App, or send a written request to the postal address or email address of BIBLIOSCORES as indicated above.
The written request must contain at least:
- Photocopy of your ID card (D.N.I.) or equivalent document for the purpose of verifying your identity.
- The subject of your request, that is, the right you are going to exercise.
If you believe your rights regarding the protection of your personal data have been violated, especially if you have not obtained satisfaction in the exercise of your rights, you may file a complaint with the competent Data Protection Authority (Spanish Data Protection Agency) through its website: www.agpd.es.
2.7 Data Source and Accuracy.
The personal data processed by BIBLIOSCORES come directly from you:
The categories of data processed are:
- Identification data
- Identification codes or keys
- Age and nationality
- Postal or email addresses
- Payment data
The USER guarantees that the data provided are true, accurate, complete, and up-to-date, committing to inform about any changes regarding the data provided, through the channels enabled for this purpose and indicated in point one of this policy. The USER shall be responsible for any direct or indirect damage or harm that may arise as a result of non-compliance with this obligation.
In the event that the USER provides third-party data, they declare that they have the consent of the interested parties and undertake to transmit the information contained in this clause to them, releasing BIBLIOSCORES from any liability arising from this.
COOKIE POLICY
In compliance with the provisions of article 22.2 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (together with the provisions of Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights-LOPDGDD- and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of individuals with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation)-GDPR-), the USER will be informed about the cookie collection and processing policy.
Accessing and browsing our APP, or using its services, requires the use of cookies on your device to ensure the USER’s browsing experience is as satisfactory as possible.
In the event that the USER gives their consent, which is granted when clicking on the «Accept all cookies» button found in the informational banner, the APP will use cookies to obtain more information about the USER’s preferences and personalize the APP according to the USER’s individual interests. Likewise, the USER is provided with the option to configure application cookies, as well as to reject all those that are not strictly necessary for the technical functioning of the APP.
What are cookies?
A cookie is a file that is downloaded to your computer when you access certain web pages/apps. Cookies allow, among other things, storing and retrieving information about a user’s browsing habits or their device and, depending on the information they contain and how your device is used, they can be used to recognize the user.
The specific uses we make of this technology are described below:
- Obtain the date and time of the last time the USER visited our APP.
- Design content that the USER chose on their first visit to our APP.
- Security elements involved in controlling access to restricted areas.
- Number of visits, page views, IP address, etc., for the preparation of aggregated statistics and reports for the maintenance and improvement of our APP.
- Number of visits, page views, IP address, and conversion tracking parameters for the personalization of the browsing experience.
We always respect the privacy of our users. Cookies allow us to analyze USER activity to improve our APP. We do not share personal data or information about our users’ activities.
If the USER does not wish to receive cookies, they must either reject the application of all cookies or those that they do not want to apply during their visit to the APP.
Types of cookies used in the APP.
BIBLIOSCORES uses the following cookies in the APP:
